These Terms of Service (“Terms”) constitute the agreement between you and Esteban Rojas Abarca, operator of I Travel By My Own (“ITBMO”), based in Costa Rica, regarding your use of the Service.
By creating an account, using the Planner, or purchasing a trip, you agree to these Terms and the Privacy & Cookie Policy. If you do not agree, do not use the Service.
When the purchase process requires express acceptance, ITBMO may record the accepted version of the Terms, along with the date, time, and metadata reasonably necessary to demonstrate that acceptance. Acceptance of Terms
You must read these Terms before purchasing. Certain provisions may be subject to mandatory consumer rights that cannot be excluded by contract. Nothing herein is intended to eliminate any rights that applicable law grants you that cannot be waived.
What ITBMO Offers
ITBMO is a digital travel planning tool. It allows you to enter cities, dates, times, travelers, preferences, restrictions, accommodation, transportation, and other context so that ITBMO can generate a proposed itinerary.
The result may include suggested schedules, activities, routes, approximate times, distances, duration, notes, must-sees, and day trips. It can also be exported to PDF and CSV when those features are available.
ITBMO is not a travel agency, tour operator, airline, hotel, transportation company, insurance company, immigration authority, or provider of linked external services.
Account, capacity, and responsibility for information
You must have the legal capacity to enter into the corresponding contract or have valid authorization. You are responsible for the accuracy of the information you enter and for the use of your session.
If you enter details of accompanying persons, including minors, you confirm that you have the right or authorization to do so and that you will only share information necessary to plan the trip.
Purchase, Price, and PayPal
You can complete and review the Planner before paying. Checkout is only requested when you select Start Planning.
During the promotional period shown on the interface, a trip may be priced USD $2.99 compared to the regular price of USD $7.99, equivalent to an approximate promotional savings of 63%. Prices and promotions may change for future purchases, but the applicable amount will be displayed before confirming payment.
One purchase covers a single trip, which may contain 1 to 3 cities within the same itinerary. The 3-city limit does not mean 3 generations or 3 separate itineraries. If you need to plan more than 3 cities, you will need to start an additional generation and pay the price applicable to that new generation.
Payments are processed via PayPal. PayPal's terms, policies, verifications, fraud controls, or procedures may also apply when paying.
You are responsible for reviewing the currency, amount, and purchase details before approving the purchase.
Immediate start and right of withdrawal
The Service is designed to begin immediately after payment confirmation. This includes access to Info Chat and the interactive post-payment personalization phase, where you can add or confirm Preferences / Restrictions / Special Conditions. After proceeding with ITBMO, ITBMO may request the accommodation zone or reference, the means of transport, and the final language of the itinerary before ITBMO begins generating itineraries.
Where applicable law recognizes a right of withdrawal or cancellation for services or digital content, ITBMO will display the information and request the legally required indications before purchase to begin service immediately, including, where applicable, confirmation that the user requests immediate commencement and acknowledges the legal consequences that such a request may have on their right of withdrawal.
Nothing in these Terms eliminates a right of cancellation, refund, warranty, or remedy that is unwaivable under applicable law.
What a Generation Includes
After payment confirmation, ITBMO enables the customization and planning phase. Info Chat becomes available according to the limits shown on the interface; you can complete or confirm Preferences / Restrictions / Special Conditions and, upon continuing, ITBMO may request the zone or reference of the accommodation and the means of transport for each city, and subsequently the language of the itinerary.
A generation is considered delivered when the Service produces and makes available to the user a usable itinerary on the interface, even if the user chooses not to download it.
The itinerary PDF, CSV file, and payment receipt are generated for download, opening, or sharing during the session, depending on the device and browser features. You must save them to your device. ITBMO does not guarantee that these files will remain available after closing, reloading, or restarting the Planner. If you use Reset, the active trip may be removed from the interface, and a new trip will require a new purchase at the applicable price, unless support expressly provides a replacement.
Info Chat
Info Chat is enabled after payment and is for questions related to the cities included in that trip. It can help you with accommodation areas, transportation, activities, logistics, and other travel-related questions.
Included usage is subject to a limit of up to 10 queries per paid route. The applicable limit is clearly displayed before purchase.
ITBMO may apply reasonable technical limits on length, frequency, context, or volume to protect availability, costs, security, and prevent abuse.
Artificial Intelligence and Variability
ITBMO and Info Chat use artificial intelligence. By their nature, two identical requests may produce different results. Outputs may contain inaccuracies, omissions, errors, or outdated information.
ITBMO designs ITBMO to prioritize geographical logic, must-see attractions, traveler context, accommodation as a reference point, and route efficiency, but it does not guarantee that one generation of a specific route will be identical to another, that it will include a specific location, or that it will represent the only or best possible route.
The Planner allows multilingual interaction in languages supported by the chat. Availability, language detection, and quality may vary depending on the language. If a language is not supported, ITBMO may indicate this during the conversation. The language used for the conversation does not necessarily determine the final itinerary language, which is selected later within the planning flow.
Your obligation to verify critical information
Do not rely solely on the itinerary for decisions that may affect connections, security, documentation, money, or legal compliance.
Before traveling or booking, you must verify directly with current sources, operators, or authorities, as appropriate:
- opening and operating hours;
- prices, availability, tickets, and reservations;
- Flights, trains, ferries, buses, tours, and departure points;
- Traffic, closures, roadworks, routes, and actual travel times;
- Weather and outdoor activity conditions;
- Visas, passports, vaccinations, health, customs, or immigration requirements;
- Security alerts, local restrictions, and official recommendations.
Never use an estimated travel time as the sole basis for arriving at an activity with a fixed schedule. Add sufficient margin.
Third-Party Services, Links, and Bookings
ITBMO may link to KAYAK / Travelpayouts, Skyscanner, Booking.com, GetYourGuide, Viator, Omio, Airalo, Holafly, and other services, whether affiliated or not.
ITBMO does not control the availability, inventory, final price, quality, security, cancellations, refunds, exchanges, fulfillment, or customer service of those third parties. If you purchase from an external site, the corresponding contract is made with that provider according to their own terms and policies.
The inclusion of a link does not constitute a warranty, agency, partnership, joint venture, or employment relationship with the provider.
Generation Failures, Duplicates, and Refunds
retry generation at no cost, grant a replacement generation, or issue a refund a refund.
In the event of a disconnection, interruption, or page reload, the Service may retain the necessary progress and attempt to resume paid generation, keeping completed cities and retrying pending ones. If the available attempts are exhausted, the user should not repeat the purchase and should use the available retry option or contact support for review.
Once a usable itinerary has been delivered, the purchase is normally non-refundable due to a change of mind, modification of plans, subjective disagreement with a recommendation, a decision not to travel, or because a hypothetical second generation might produce different results, unless applicable law requires otherwise.
If you notice a duplicate or unrecognized charge, please write to support@itravelbymyown.com with the available transaction information. PayPal dispute mechanisms may also exist, subject to their rules.
Nothing in this section limits rights of refund, reversal, conformity, or warranty that cannot be waived under applicable law. Where a mandatory rule on digital services or content provides additional remedies for non-delivery or non-conformity, ITBMO will address the remedies legally enforceable under applicable jurisdiction.
Acceptable Use
You cannot use ITBMO for:
- Violate laws, third-party rights, or security measures;
- Automate bulk queries, scrape, or unauthorized extraction;
- Circumvent usage, payment, session, or technical control limits;
- Interfere with the Service or attempt to access unauthorized systems;
- Introduce malware, malicious code, or instructions intended to compromise the system;
- Resell or commercially exploit results in an unauthorized manner;
- Impersonate third parties or use unauthorized payment methods.
Intellectual Property
The site, ITBMO brand, design, software, code, structure, interfaces, ITBMO, graphic elements, and proprietary content are protected by applicable rights.
ITBMO grants you a personal, limited, non-exclusive, and non-transferable license to use the generated itinerary for your personal travel and use, subject to these Terms.
Third-party trademarks and materials belong to their respective owners, and their use, where applicable, will be subject to the relevant authorizations or guidelines.
Limitation of Liability
To the fullest extent permitted by law, ITBMO is provided “as is” and “as available.” No guarantee of uninterrupted operation, absolute absence of errors, or perfect accuracy of AI-generated content or third-party information.
To the maximum extent permitted by law, ITBMO will not be liable for losses arising solely from decisions made without verifying critical information, changes made by third parties, external cancellations, weather, closures, traffic, acts of authorities, loss of connections, insufficient documentation, accidents, injuries, or events beyond ITBMO's reasonable control.
Where the law permits the limitation of monetary liability and ITBMO has direct liability, the aggregate liability related to a specific purchase will not exceed the amount actually paid to ITBMO for that purchase, unless a mandatory rule provides otherwise.
Nothing is intended to exclude liability for fraud, willful misconduct, gross negligence, injury, or other matters that cannot legally be limited.
Liability for Your Use
To the extent permitted by law, you are liable for claims or costs caused by your wrongful use of the Service, violation of these Terms, infringement of third-party rights, or unauthorized disclosure of other people's data.
Suspension or Termination
ITBMO may limit or suspend access when reasonably necessary for security, maintenance, legal compliance, prevention of fraud, abuse, non-payment, or material breach of these Terms.
Applicable Law and Consumers
These Terms shall be construed, to the extent permitted, in accordance with the laws of Costa Rica. However, if you are a consumer in a jurisdiction that provides mandatory protections that cannot be overridden by a contractual choice of law, those protections remain in effect.
ITBMO may seek to resolve any dispute in good faith by contacting support@itravelbymyown.com support@itravelbymyown.com before resorting to formal remedies, without limiting statutory rights that cannot be restricted.
California Consumers
If you are a California consumer, nothing in these Terms is intended to waive, exclude, or limit any non-waivable rights you may have under California law where applicable.
Changes to the Service or These Terms
ITBMO may modify features, future prices, limits, or these Terms. Modifications will not retroactively affect a confirmed purchase except when required by law, for security reasons, or to correct an obvious error. Material changes will be communicated as appropriate.
